Terms

1.0 LIABILITY
We shall not be liable under any circumstances for any loss (including loss of profit) injury, expense, damage, delay, costs or compensation (whether direct, indirect or consequential) that may be suffered or incurred by the User as a result of using the Service. For the avoidance of doubt nothing in these Terms shall exclude any liability for death or personal injury arising from our own negligence (as defined in the Unfair Contract Terms Act 1977).
In no event shall we be liable for any damages of any kind related to or arising out of the use or misuse of any service provided to the User

2.0 INDEMNITY
The User shall indemnify and keep us indemnified against any costs, claims or liabilities incurred by us arising out of the use of the Service by the User.

3.0 WARRANTY
We make no warranties or representations of any kind for the Service being offered. The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including without limitation to warranties of title, non infringement, merchantability or fitness for a particular purpose.

4.0 WAIVER
No failure or delay by us in exercising any of its rights under these Terms shall be deemed to be a waiver of that right and no waiver by us of any breach of these Terms by the User shall be considered as a waiver of any subsequent breach of the same or any other provision.

The User irrevocably and unconditionally waives any rights they may have to claim damages for any misrepresentation, arrangement, understanding or agreement not contained in these Terms or for any breach of any representation not contained in these Terms (unless such misrepresentation or representation was made fraudulently).

5.0 SEVERABILITY
If any of these Terms shall be found by any court or administrative body or competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect any other provisions and all provisions not affected by such invalidity or unenforceability shall remain in full force and effect.

6.0 ENTIRE AGREEMENT
It is acknowledged and agreed that these Terms shall supercede all prior representations, arrangements, understandings and agreements between us and the user relating to the subject matter hereof and shall constitute the entire, complete and exclusive agreement and understanding between them. The User acknowledges and agrees that no representations, arrangements, understandings or agreements (whether written or oral) made by or on behalf of us have been relied upon other than those expressly set out or referred to in these Terms.

7.0 LAW
These Terms shall be governed by and construed and interpreted in accordance with English law and the parties hereby submit to the exclusive jurisdiction of the English courts.
